THE NCX PRIVACY POLICY

The following guidelines outline the privacy policy that the National Cyber Exchange (the “NCX”) will follow in collecting, maintaining, and using the information it receives through your interactions with its website and it subparts, found in desktop and mobile formats at www.nationalcyber.org (the “Website”).  These guidelines have been developed to support and supplement the Website’s Terms & Conditions, which may also be found on the Website, and are incorporated by reference. 

Due to the constantly evolving nature of the internet and the legal policies that surround it, the NCX reserves the right to unilaterally update these guidelines and the Terms & Conditions they support.  Each revision shall be effective when posted, and shall immediately supersede and replace any versions that proceeded it.  While the NCX will endeavor to provide you with notice of each revision, delivery of notice shall not be contractually required.  You are thus encouraged to periodically review these guidelines and note any changes.  Like the Terms & Conditions, these guidelines cannot be revised or accepted in piecemeal.  If you object to a specific revision, you must discontinue your use of the Website and its services.  Your use of the Website and its services shall constitute an express acceptance of the privacy guidelines in effect at the time of use.

Consistent with the Terms & Conditions, the NCX does not audit, vet or endorse the privacy policies of any webpages linked to the Website.  You are accordingly responsible for reviewing the terms and conditions associated with each website you visit, and should not assume they will follow the privacy policy outlined below.

 

1. What Information Does the NCX Gather?

During your interactions with the Website, the NCX shall gather the following types of information.

Registration Information.  The NCX will collect any information you provide when registering to use the Website and its services including, but not limited to, your name, e-mail address, and demographic information (e.g., your age, sex, and the city in which you work).

Traffic Information.  The NCX will collect your computer’s I.P. address, the browser type you use, your access times, data from undeleted cookies, and other numeric measures or codes used to track your computer’s interaction with the Website.  This information allows the NCX to measure a computer’s interaction with the Website and use of its services.  With the exception of cookies discussed below, all of the traffic information we gather from your interactions with the Website shall be nonidentifying, in that it will not identify you personally, and will be used to improve the Website and may occasionally be shared with third-parties for marketing purposes.

Cookie Information.  The NCX will use cookie-based tracking to identify you and confirm your rights to access the Website and its services.  The NCX’s gathering of this information is contingent upon your acceptance of the cookies used to gather it.  If you refuse to accept cookies from the NCX, your access to certain portions of the Website and its services may be restricted or blocked entirely.  From time to time, we may also a third-party advertising server to display ads on the Website and some of the ads posted by these servers may contain cookies specific to the advertiser.  We do not have access to these cookies or the information they gather, and acceptance of these cookies, or the cookies sent from any party other than the NCX, is optional and shall not affect your use of the Website or its services.

Credit Card & Payment Information.  The NCX uses a third-party merchant service to process all online payments.  Accordingly, the NCX does not routinely keep or store your credit card or other payment information.  In the event the NCX is given your credit card or other payment information, it shall keep such information only so long as necessary to process the payment and transfer the information to its merchant service provider.  All information provided to the NCX’s third-party merchant provider shall be kept secure in accordance with the provider’s internal policies and procedures.  Information on the NCX’s current provider shall be provided upon request.

 

2. How is Your Information Used?

The information the NCX gathers shall be put to the following uses:

Statistical Analysis & Banner Advertising.  The NCX may use your anonymous traffic information to analyze user behavior and measure interest in the various areas of our site (for product development purposes) or to inform advertisers as to how many consumers have seen or “clicked” their advertisements.  The NCX also uses demographic information to allow advertising banners on our Website to be targeted, in aggregate, to the readers for whom they are most pertinent.  This means that readers see advertising that is most likely to interest them, and advertisers send their messages to people who are most likely to be receptive, improving both the viewer’s experience and the effectiveness of the ads.  In this statistical analysis and banner advertisement targeting, we will disclose information to third-parties only in aggregate form.  Personal information about you as an individual subscriber or registrant will not be provided to any third-party, except when we have your permission or if there are unique circumstances requiring disclosure in a manner consistent with the Terms & Conditions or any nondisclosure agreement you executed with the NCX.

E-mail.  The NCX may use the e-mail addresses you provide, information about our services, updates on your account and notices required by the Terms & Conditions.  Occasionally, the NCX shares data collected about subscribers with other units within the NCX group of companies or third-parties whose products or services we feel may be of interest to you.  Many of our subscribers find these mail or e-mail promotions valuable, whether they are shopping for merchandise, taking advantage of a special offer or purchasing unique services. Data Security.  To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, we have put in place appropriate physical, electronic, and managerial procedures to protect the information we collect online, including utilizing third party payment services for security for credit card submissions.  Detailed information about PCI security for credit card submissions is available from the PCI Security Standards Council at: https://www.pcisecuritystandards.org/pci_security/

 

3. When & How is Your Information Shared?

The NCX shares the information it gathers, in aggregate form, with advertisers and other partners.  The NCX does not release personal information about you as an individual to third-parties, except when we have your permission or under special circumstances described in the Terms & Conditions.  The NCX will provide you all of your personal information provided at registration upon request. This information will only be sent to an e-mail provided during the registration process.

The Website provides it users with a variety of message boards as a means of exchanging information with each other.  The content of these boards is generally available to all users with access to the Website and is thus not governed by these privacy guidelines.  Any information you disclose when posting a message in a board becomes public to all users with access to it.  You should always be careful when distributing your personal information in this manner.  If you choose to participate or post messages in the NCX’s boards, we will collect such information about you as you choose to disclose.  If you send the NCX personal correspondence about your activities or postings on the NCX’s Website, the NCX may collect such information in a file specific to you.

The boards may be used only for non-commercial purposes.  You may not post any material concerning promotion, advertising or solicitation for goods or services without the NCX’s prior consent. From time to time the boards may be monitored by the NCX in order to maintain professional decorum and to prevent prohibited uses of the boards.  The NCX reserves the right to remove any material, message or discussion thread that is, in the sole judgment of the NCX, inappropriate.  For more information about the boards, please review our Terms and Conditions of Use or contact the NCX by e-mail.

 

A Special Note About Children.

Children under 13 are not eligible to use the NCX’s services, and we ask that minors not submit any personal information to us.  If you are a minor, you may use this service only in conjunction with a parent or guardian.

 

Opting-Out, Corrections and Cancellations.

Upon request, the NCX will:

  • remove you and your personal information from our database, thereby canceling your registration;
  • correct personal information that you state is erroneous; or
  • permit you to “opt out” of further e-mail contact (except notification of major changes to the service) while still allowing access to the site.
